P-1 Visa: Internationally Recognized Athletes and Entertainers

P-1A: Athletes

  • Purpose: For athletes who are internationally recognized and wish to compete in the U.S.
  • Requirements:
    • The athlete must be internationally recognized as being at the top of their sport.
    • The U.S. employer or organization must file the petition.
    • Must provide evidence of the athlete's achievement and recognition, such as awards, rankings, or media coverage.
  • Duration: Initially granted for up to five years, with extensions possible for up to a maximum of ten years.

P-1B: Entertainers

  • Purpose: For members of an internationally recognized entertainment group (such as a band or theatrical group) or entertainers who which to perform in the U.S.
  • Requirements:
    • The group must have achieved international recognition as being outstanding in its field.
    • At least 75% of the group must be foreign nationals.
    • The petition must include evidence of the group's achievements and recognition.
  • Duration: Initially granted for up to one year, with extensions possible for up to a maximum of ten years.

P-2 Visa: Artists and Entertainers (Exchange Program)

  • Purpose: For artists and entertainers who are participating in an exchange program between the U.S. and another country, often through a cultural exchange agreement.
  • Requirements:
    • Must be coming to the U.S. to perform as part of an exchange program between organizations.
    • The petition must include details of the exchange program and how the individual or group will contribute.
    • The U.S. petitioner (such as a sponsor or organization) and the foreign counterpart must be part of the exchange program.
  • Duration: Initially granted for the duration of the exchange program, up to one year, with extensions possible if the program continues.

P-3 Visa: Artists and Entertainers (Culturally Unique)

  • Purpose: For artists or entertainers who perform or teach in a culturally unique program or practice, which is a distinct cultural or traditional form of performance.
  • Requirements:
    • The performance or activity must be culturally unique (i.e., distinct and not widely performed or taught in the U.S.).
    • The petition must include evidence of the artist's or entertainer's involvement in culturally unique activities and how their performance or teaching contributes to the cultural exchange.
  • Duration: Initially granted for up to one year, with extensions possible for up to a maximum of five years.

P-4 Visa: Dependents of P-1, P-2, and P-3 Visa Holders

  • Purpose: For dependents (spouses and children under 21) of P-1, P-2, and P-3 visa holders.
  • Requirements:
    • The dependent must be accompanying the primary visa holder.
    • The dependent does not need to demonstrate eligibility for their own visa but must be able to prove their relationship to the principal P visa holder.
  • Duration: The P-4 visa is valid for the same duration as the principal P visa holder's stay in the U.S.

Application Process

  • 1. Petition Filing: The U.S. employer or organization files a petition with USCIS using Form I-129 (Petition for a Nonimmigrant Worker).
  • 2. Supporting Documentation: Include evidence of the individual's or group's achievements, international recognition, or involvement in an exchange program.
  • 3. Approval: Once the petition is approved, the visa holder and their dependents (if applicable) can apply for a visa at a U.S. consulate or embassy.
